Comstock / IDCS Subscriber Agreement

• Neither Wifin, IDCS, their affiliates, Sources nor any third-party licensor shall have any liability for (i) the accuracy or completeness of the information or software furnished through the Wifin Service, (ii) delays, interruptions or omissions therein or (iii) lost profits, indirect, special or consequential damages;

• Any one of Wifin, IDCS, their affiliates, Sources or third-party licensors have exclusive proprietary rights in the information or software received in the Wifin Services;

• Subscriber shall not use or permit anyone to use the ComStock information or software provided through the Wifin Service for any unlawful or unauthorized purpose;

• Subscriber is not authorized or permitted to furnish the ComStock Information or software to any person or firm for reuse or retransmission without prior written approval of the provider or source of such information or software;

• Subscriber acknowledges that its arrangement with Wifin for receipt of the ComStock Information is subject to termination without prior notice in the event that this Agreement between Wifin and IDCS is terminated for any reason;

• Subscriber agrees, where applicable, to make application to and receive written approval for receipt of the ComStock Information from each and every source prior to receipt of the ComStock Information and agrees to comply with any conditions, restrictions or limitations imposed by any of the Sources, including paying all fees or charges as such Sources may impose either directly or through IDCS or through Wifin;

• Subscriber acknowledges that the Sources described in the preceding paragraph may have the right to terminate provision of the ComStock Information to subscriber with or without notice and that neither any such Sources, IDCS nor Wifin shall have any liability in connection therewith.
